2. Scope of Services

2.1 The Company provides rubbish removal and waste collection services, including but not limited to household waste clearance, garden waste removal, office and commercial clearances, and general junk removal, subject to availability and compliance with relevant regulations.

2.2 The Company will use reasonable care and skill in providing the Services and will make reasonable efforts to dispose of all collected waste in a lawful and environmentally responsible manner through licensed facilities.

2.3 The exact scope of the Services for a particular job, including the type and approximate volume of Waste to be removed, collection address, access requirements, and timing, will be confirmed at the time of Booking or in a subsequent confirmation message.

2.4 The Company reserves the right to refuse or suspend Services where it considers that the type of Waste, site conditions, or access issues pose a health and safety risk, are unlawful, or fall outside the scope of services the Company ordinarily provides.

3. Booking Process

3.1 Customers may request a Booking by contacting the Company via telephone, email, or any other contact method advertised by the Company. The Customer should provide accurate details of the collection address, type of Waste, approximate volume, and any access restrictions.

3.2 Any quotation provided prior to inspection is based on the information supplied by the Customer and is an estimate only. The final price may be adjusted at the time of collection based on the actual volume, weight, type of Waste, and conditions on site.

3.3 A Booking is only confirmed once the Company has accepted the Customer's request and supplied a confirmation by telephone, email, text message, or other agreed method. The Company may, at its discretion, require a deposit or pre-authorisation of payment before confirming a Booking.

3.4 The Customer is responsible for ensuring that someone with authority is present at the collection address at the agreed time, unless the Company has explicitly agreed to carry out the Services in the Customer's absence.

3.5 The Company aims to arrive within agreed time slots, but all times are estimates and may be subject to change due to traffic, weather, or other factors beyond the Company's control. The Company will use reasonable efforts to notify the Customer of any significant delay.

4. Pricing and Quotations

4.1 Prices for the Services are generally based on the volume and type of Waste to be removed, as well as access conditions and any additional labour required. The Company may use load capacity, cubic yardage, or similar measures to determine pricing.

4.2 Quotations provided before a site visit are indicative and given in good faith based on the Customer's description of the Waste and conditions. If the actual Waste differs in type, volume, or difficulty from that described, the Company reserves the right to revise the price before commencing the work.

4.3 If the Customer does not agree with a revised price offered on site, the Customer may decline to proceed, and no Services will be carried out. The Company may, however, charge a reasonable call-out or attendance fee if this has been communicated in advance.

4.4 All prices are quoted in pounds sterling and, unless otherwise stated, are inclusive of any applicable taxes, disposal fees, and standard labour charges.

5. Payment Terms

5.1 Payment is due in full upon completion of the Services, unless otherwise agreed in writing before the start of the work. For certain bookings, the Company may require full or partial payment in advance.

5.2 The Company accepts payment by cash, debit card, credit card, bank transfer, or other payment methods that it may make available from time to time. The methods available for a particular job will be confirmed by the Company.

5.3 Where payment is made by card, the Customer authorises the Company to charge the agreed amount to the card details provided. The Customer confirms they are authorised to use the payment method supplied.

5.4 For commercial Customers with accounts, payment terms may be subject to a separate written agreement. In the absence of such an agreement, invoices are payable within 14 days of the invoice date.

5.5 If the Customer fails to make payment on the due date, the Company reserves the right to charge interest on overdue amounts at the statutory rate and to recover any reasonable costs incurred in pursuing the debt, including legal and collection agency fees.

6. Cancellations and Amendments

6.1 The Customer may cancel or amend a Booking by contacting the Company as soon as reasonably possible. The Company encourages Customers to provide at least 24 hours' notice prior to the agreed collection time.

6.2 Where the Customer cancels with more than 24 hours' notice, no cancellation fee will normally apply. Where the Customer cancels with less than 24 hours' notice, the Company may, at its discretion, charge a reasonable cancellation fee to cover costs incurred and loss of opportunity.

6.3 If the Company arrives at the collection address at the agreed time and is unable to gain access, or the Customer fails to present the Waste for collection, this may be treated as a late cancellation. In such circumstances, the Company may charge a call-out fee or a proportion of the quoted price.

6.4 The Company reserves the right to cancel a Booking at any time due to operational issues, unsafe conditions, adverse weather, staff availability, or other factors beyond its control. In such cases, the Company will use reasonable efforts to notify the Customer and rearrange the Services at a mutually convenient time. The Company will not be liable for any indirect loss arising from such cancellation.

7. Customer Responsibilities

7.1 The Customer must ensure that the collection address is accurate and that safe, reasonable access is available for the Company's vehicles and team. This includes obtaining any necessary permissions for parking or access to private land.

7.2 The Customer must inform the Company in advance of any hazards, restricted access, or special circumstances that may impact the safe and efficient completion of the Services.

7.3 The Customer is responsible for separating or clearly identifying the Waste to be removed, ensuring that prohibited items are not mixed with general rubbish. If the Customer is unsure about any items, they must notify the Company before the work begins.

7.4 If the Company's team members are asked to enter the Customer's property, the Customer must ensure the environment is safe and that the route to the Waste is clear and reasonably free of obstructions.

8. Waste Types and Prohibited Items

8.1 The Company operates in compliance with applicable UK waste regulations and will not collect or transport any items that cannot legally be handled under its licences or insurance.

8.2 Prohibited items may include, but are not limited to, asbestos, certain chemicals, solvents, medical waste, biological or hazardous materials, gas bottles, pressurised containers, explosives, and any waste classified as hazardous beyond the Company's authorisation.

8.3 If prohibited items are discovered within the Waste at the time of collection, the Company may refuse to remove those items, adjust the price, or decline to carry out any further Services. The Customer may be charged a reasonable fee for any additional time spent on site.

8.4 The Company may be able to arrange specialist disposal for certain restricted materials by prior agreement. Any such arrangements will be subject to separate pricing and specific terms agreed with the Customer.

9. Waste Handling and Disposal

9.1 The Company will handle, transport, and dispose of collected Waste in accordance with applicable UK waste legislation and environmental regulations. This includes using authorised waste transfer stations and disposal or recycling facilities.

9.2 Once the Waste has been loaded onto the Company's vehicle and payment has been made or agreed, title and responsibility for that Waste will transfer from the Customer to the Company, subject to applicable legal requirements.

9.3 The Company will use reasonable efforts to maximise recycling and recovery of materials where commercially and operationally feasible, but it does not guarantee that any particular proportion of Waste will be recycled.

9.4 At the Customer's request, and where required by law, the Company may provide a waste transfer note or documentation evidencing lawful disposal, subject to any applicable administrative charge.

10. Damage and Liability

10.1 The Company will take reasonable care when carrying out the Services. However, the Customer accepts that minor scuffs or marks may occur where large or heavy items are removed from tight spaces, and that some risk of incidental damage is inherent in rubbish removal work.

10.2 The Customer should remove or protect any fragile items, floor coverings, and fittings that may be at risk of damage before the Services commence. The Company is not liable for damage to items that the Customer has failed to secure or protect.

10.3 The Company's total liability for any direct loss or damage arising from the provision of the Services, whether in contract, tort, or otherwise, shall be limited to the total price paid or payable by the Customer for the specific job in question, except where such limitation is not permitted by law.

10.4 The Company is not liable for any indirect, consequential, or economic losses, including but not limited to loss of profit, loss of business, or loss of opportunity, arising from or in connection with the Services.

10.5 Nothing in these Terms and Conditions shall limit or exclude the Company's liability for death or personal injury caused by its negligence, fraud, or any other liability that cannot legally be limited or excluded.

11. Insurance

11.1 The Company maintains public liability insurance and, where applicable, employer's liability insurance to cover its activities in providing rubbish removal services.

11.2 Details of the Company's insurance cover are available on request. The existence of insurance does not extend or increase the Company's liability beyond that set out in these Terms and Conditions or required by law.

12. Complaints and Disputes

12.1 If the Customer is dissatisfied with any aspect of the Services, they should notify the Company as soon as possible, providing details of the issue and any supporting information.

12.2 The Company will investigate complaints in good faith and aim to provide a response or proposed resolution within a reasonable time. The Customer agrees to give the Company a reasonable opportunity to address any concerns.

12.3 Where a dispute cannot be resolved informally, the Customer and the Company agree to consider negotiation or mediation as a first step before commencing any formal legal proceedings, where appropriate.

13. Force Majeure

13.1 The Company shall not be liable for any failure or delay in performing its obligations under these Terms and Conditions where such failure or delay is caused by events beyond its reasonable control, including but not limited to acts of God, extreme weather, strikes, transport disruptions, or accidents.

13.2 In such circumstances, the Company may suspend or reschedule the Services and will use reasonable efforts to notify the Customer and minimise disruption.

14. Data Protection and Privacy

14.1 The Company will collect and process personal data from Customers only to the extent necessary to manage Bookings, provide the Services, and handle payments and communications.

14.2 The Company will take reasonable steps to keep personal data secure and will not sell or rent Customer information to third parties. Data may be shared with service providers such as payment processors or waste facilities where reasonably necessary to perform the Services or comply with legal obligations.

14.3 Customers have the right to request access to their personal data held by the Company and to request correction of inaccurate information, subject to applicable data protection laws.

15. Changes to These Terms

15.1 The Company may update or amend these Terms and Conditions from time to time. Any changes will take effect from the date they are published or otherwise communicated to Customers.

15.2 For existing Bookings, the version of the Terms and Conditions in force at the time of confirmation of the Booking will apply, unless the Customer agrees in writing to be bound by a revised version.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them, or with the provision of the Services, shall be governed by and construed in accordance with the laws of England and Wales.

16.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

17. General Provisions

17.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17.2 The failure of the Company to exercise any right or remedy under these Terms and Conditions shall not constitute a waiver of that right or remedy.

17.3 These Terms and Conditions constitute the entire agreement between the Customer and the Company in relation to the Services and supersede any prior discussions, correspondence, or understandings.

By proceeding with a Booking or using the Services of Rubbish Removal Maida Vale, the Customer acknowledges that they have read, understood, and agreed to be bound by these Terms and Conditions.
